I drove it a few times these last few days and itâ™s painfully loud. It hurt my ears so I can imagine what it does to my mums ears and other drivers.
Anyways The problem first occurred at about 3500 miles and we took it in for service but all the dealership did was put some brake quiet spray on the pads then about 500 miles after that date of service the squealing sound came back and again it was taken it in. Itâ™s been taken in for service 4 times now, going on 5 with the exact same problem and the dealership mechanics still havenâ™t taken care of the problem.
Does my mum have a lemon law case??
I was researching about the lemon law on this site but want a better understanding from others...

5. Sit back and let Mum collect insurance.
I don't think it applies to parts that wear out like that but what they should do is change the brakes out to see if that fixes the problem and that way they can narrow down what the problem might be.
do you have a mechanic that you otherwise go to? If so,let them check it out and present the dealership with the bill. They apparently aren't fixing the problem.

Possibly, certainly noise from a brake signals that it is not functioning as designed. This could be a serious safety issue. I think I would write a carefully worded letter that states my concerns about the possible safety issues involved along with my severe fear of driving the vehicle under these conditions. Since the dealership has been aware of the problem and not been able to fix it, what steps does Nissan ? That I would very much like to have the problem resolved before taking further steps, as I am sure they would agree.
Or something like that. Send a copy to Nissan, the Nissan Factory Rep and the Dealership. Give them 14 days for a response. Then contact an attorney. Brakes are a safety issue and under CA lemon law a covered item.
No, she does not. A noise that she finds annoying is not grounds for a suit. Nissan will argue that the brakes are functioning properly and they have serviced it for free under the warranty, so she will get no where. You can talk to an actual lawyer about this by calling 1-800-lemon-law, but they will tell you the same thing I just did.
