Since we had a bunch of things come up ever since we bought it does the CA lemon law apply to our car? Or, does it sound like we are basically stuck with a car that will need repairs???
The latest instance SCARED the hell out of me because while I was idling at a stop light, smoke (grey colored smoke) started coming from the back of my car... would that possibly warrant the dealer taking it seriously enough to try to work something out?
I'm mainly worried because we have 4 kids all in car seats and now with smoke coming from the car I'm worried something may happen one time when I'm driving and won't be able to get them out in time...
Thoughts?
Based on my reading of a summary of the statute, this doesn't SOUND like a lemon law case. It sounds like the dealer successfully repaired each problem as it came up, hopefully under warranty. While you seem to have had a higher incident rate than usual for the suburban (although it is not rated very reliable to begin with), you also have put fairly heavy mileage on it in two years as well, so you can't really make the case the car was out of service.
The approach I would probably take is to talk first to the service manager and indicate your history and general dissatisfaction, and see what they offer. I'll assume the car had a standard warranty and is out of it now. Depending on their response, you have nothing to lose by talking to the dealer about a replacement and seeing if you can get them to kick in a little extra trade in because of the problems.
As I understand the CA lemon law it is aimed at dealing with one problem the dealership can not correct after repeated attempts. Call any consumer advocacy group and talk to them. I could be wrong, it wouldn't be the first time but I think you are stuck with a clunker. Sorry.
State lemon laws usually only come into play if the dealer attempts to do a repair and is unable to do it, multiple repairs does not activate the lemon law here it is so you can get the info first hand.~
