Does the lemon law apply to everyone?

i purchased a new vehicle at the end of June and its already dead and in the shop. The vehicle was sold "AS IS" but the mechanic told me that its a pre existing condition and so the AS IS doesnt apply. Should the dealership who sold me my car give me my money back?


When you purchase a vehicle "as is" you can not get your money back.......

"As is" means that you bought the vehicle with no implied warranty and you are responsible, even if you would have broken down driving home.

The only way they could be held liable is if they did a state inspection and there are things on the vehicle that would not pass by your state's inspection laws.

You could go back to the dealer and tell them the vehicle is FUBAR and see if they will take it in on trade.

You bought a used car. It said AS IS. That means if you drove 19 miles and the engine blew... your screwed.. you bought it AS IS. So a pre-existing condition is exactly what the AS IS covers. This is why people sell extended warranty's!!!

Don't waste your money or time trying to go after the dealer who sold you the car. You didn't do your due diligence by taking it to another dealership to inspect and recommend the car for purchase.

Check with your state Attorney General's office to find out what your rights are. Usually their website has all the information you need.

They cannot sell you a new vehicle without giving a warranty. It is the manufacturer who covers the warranty. If you bought the vehicle new, contact the manufacturer and inform them you want to make a claim under the Lemon Law. They have to have an opportunity to repair the vehicle. If it gets repaired then runs properly, the warranty obligation is met.

You can only make claim for a refund or for another new vehicle if yours cannot be repaired.

Call a local lawyer. Most will answer one question without charge.

The lemon law only applies to brand new cars, not used.

If your car has been used, you are not eligible to use the lemon law as a way to get out of your car.
