How exactly does Lemon Law work in CA?

I purchased a car in Sept. of 06. In February of 08 with 15,000 miles on the car I brought the car in for a problem when changing gears. They couldnt diagnose the problem because they said it wasnt frequent enough. I then brought the car in again for that same problem plus a vibration that lasted 4 seconds and occurred every 20 minutes in the beginning of July. They said they felt the problem when we test drove it and tried to fix it. When the car was picked up a week later, it was still doing the same thing. It was brought back again and we were told again that it lasted too short a time each time for them to figure out what was wrong. After many talks with the manager and more tests run on the car, they are now going to change the transmission. If this does not resolve it, do I qualify for Lemon Law or do they have to try to fix it another time? The car now has 19,000 miles on it because of all the test drives they have done on it. Does that change anything?

You need to see a lawyer. The dealers will stall and lie.

If you meet in an accident and you have already started a lemon law case. Can you still proceed in CA?

I have already started the case we are about to finish and i got in a hit and run in a parking lot. Does this give the car manufacture the right to dismiss the case in the state of CA?


no,the issues you have with the car manufacturer is still valid, getting in a accident that wasn't your fault doesn't dismiss the case

Does Lemon law in Ca apply to fridges under warrnaty, if yes how many tries does the vendor get to fix it .?

Repair men have come to my home 5 times, and worked on the fridge twice by putting in new compressor they are going to put in a third compressor which probably wont work


I don't know if the lemon law goes there, but you could write the manufacturer. I am sure they would like to knoe the type of service you are getting.

CA Lemon Law?

when you file a lemon law case in california do you (the consumer) have to pay the attorney? or does the car maker have to pay those fee's?


You can try to add the lawyer's fees as part of your damages, but whether or not the judge will award you anything is up to the courts.

i had many years ago lemon law,and did not have an attorney,me and my bf, i won the case, what you really need is everything should be documented, than you will have very good case,

Does anyone know if there is a Lemon Law in CA regarding used cars?

I have a friend who went to a local used car lot on Friday and got a car. Everything went fine during the test drive, so she decided to go for it. She signed something stating that she was buying the car "as is." Saturday morning the battery went dead and there is rusty sludge in the radiator. Is this legit? Do you think she is going to be stuck buying this car, or is there a law that can help back her up? Any help would be great.


Here are the basics of the California "Lemon Law". From what I read, since she bought it "as is", it does not apply, unliss this a "lemon buy back". Then they have to offer a 1 year warranty on it.

Unless it is a lemon buy back, about the only thing she can do is go back to the lot and talk to them, hoping they will do what is right. It looks like there's no real leagal recourse.

Vehicles Covered in California

Any motor vehicle, not including commercial vehicles or vehicles designed primarily for off-road usage.

Lemon Period in California

18 months or 18,000 miles, whichever occurs first.

Number of Repair Attempts

Four (4) repair attempts, at least one of which must have occurred during the "Lemon Period", or 30 cumulative calendar days out of service during "Lemon Period".

Used Vehicles Covered?

Yes, as long as sold during the "Lemon Period" and not sold "As is".

Remedies Available by California Lemon Law

Comparable new vehicle or refund less mileage offset.

You have to be careful when you purchase a vehicle AS IS. The dealers make you sign all kinds of forms that take them off the hook in case of a law suit. A dead battery is not much of a serious problem and it is not covered under any warranty no matter what time, so she needs to go out and purchase a new battery. To answer your question there is a lemon law on every state is just the rhetoric that changes from state to state.

the law on used cars is pretty much the same ,when it has that sticker that says as is,and you sign it,this means your accepting it like it is,and the lemon law wont apply on this one,its the same way here in Tennessee also ,a lot of people buy them every day only to discover that have been taken again on a used car,but on those i hate to say it but its buyer beware,sorry they got a lemon,but maybe it can be fixed cheap enough ,good luck hope this helps.

She bought, and signed a contract for a car being sold "as is". The "as is", is the key statement. The owner likely knew about the cooling system needing flushed, and didn't bother to disclose. But when you buy a used car, it is sold just as is it is. You have no recourse, you now own this car. It may be a reasonable fix, on the other hand, with those symptoms, it could be a very expensive fix. Next time you car shop, try to take someone with you that is familiar with cars, and can help you make a good buy. It's an expensive lesson to learn about car buying. Regarding Lemon Law, that regulation covers new vehicle purchases, with manufacturer defects.

Have you used the Ca. Lemon Law against Ford? Does the dealer have the power to exchange a bad car?

I have a 2007 Ford Ranger that has trans problems (they think). They have tried twice to fix it and it's still at the dealership. I'm frustrated. Any suggestions? I live in California. Thanks


I dont know how it is in Cali. However from what Ive heard if a vehicle keeps going in for constant repairs on the same thing and within a certain time period it falls itnot the lemon law. The only thing I can suggest is found out if the lmon law is the same for the all the states.

Can anyone help me get answers about CA lemon law and used cars?

I bought a 1994 Toyota 4x4 in April 2006, and the computer has already been replaced as well as the entire wiring harness. I just want to return the truck to the dealer I bought it from. What are my options?? I've almost been killed in this truck twice because it just dies out.


Since it is a used car, it does not qualify as a lemon law car.

This does not mean that you do not have any options. My brother-in-law is a lemon law attorney and I consulted him. You should contact an attorney specializing in Consumer Protection. You might have a very strong case since your life has possibly been jeopardized by this car.

I do not believe the lemon law covers used cars in California. However a couple of questions for you, did they tell you up front that wiring harness and computer had been replaced? If they did, did they tell you why? Are you sure that the harness or computer is why its stalling? Have you called the dealer and told them what is going on? If they do not give you answers ask for the number to the factory rep. If it is truly a safety issue Toyota should be able to help you out.

That being said if they replaced those parts to fix a stalling problem and it still happens then its obvious something else is wrong. When does the car stall? Did it happen under the same circumstance? Keep in mind that when you buy a used car in California they have a sticker in the window that says if the car has a warranty or not. If yours says no warranty the dealer is off the hook unless they hid something about the car from you.
